Look here:

these Cossacks screenshots were licensed under GFDL by GSC Game World itself, so it will be okay to rip them for graphics. I.e. building sprites would definitely look better than Aleona Tales ones.

Although some people find such use unethical. I've even been banned for submitting them and other Commons sprites to OpenGameArt: http://opengameart.org/forumtopic/censo ... game-ready

Those guys at OGA are nuts. Shame the individual assets aren't GFDL.

Well, I guess Clint banned me for damaging OGA's reputation by submitting controversial sprites. They are artist friendly community, so require gaining explicit permission, even if license allows free use.

Stratagus doesn't support 3d models anyway. So no worries.

If you really want 3D, there is 0 A.D. free game engine, but in most cases 3d only distracts from gameplay, unless you explicitly use 3d features, but then again - Dwarf Fortress manages to represent dynamic 3d world using ASCII art.
